BUYER POLICY INCLUDING LIABILITY WAIVER AND USE AT YOUR OWN RISK

This Buyer Policy (“Policy”) governs your purchase and use of the breathing device (“Device”). By purchasing and using the Device, you acknowledge and agree to the following terms and conditions:

Acknowledgment of Risk:

1. I expressly acknowledge and understand that the Device is designed to facilitate conscious rhythmic breathing and promote overall wellness. The Device is not a medical device and does not provide specific medical or therapeutic treatments. The Device provides vibration prompts and acts as a vibrating metronome to assist in matching your breathing rate Its sole purpose is to support general wellness and relaxation.
2. I am aware that while engaging in breathing exercises with the Device it may have physiological effects, including, but not limited to, increased circulation, dizziness, and the potential to induce altered states of consciousness and that it should not be used while drinking alcoholic beverages, operating vehicles, vessel, or machinery, and that I should exercise caution in selecting an appropriate setting for its use. I accept full responsibility for the responsible and mindful use of the Device, including not using the Device in an environment where my attention is compromised.
3. I am using the Device voluntarily and at my own risk. I am aware of the risks involved in using the Device, which may include physical injury and psychological injury, While I retain the sole discretion to follow or deviate from the vibration patterns at my own volition, I assume all risks involved, known and unknown to me.

Release of Liability and Indemnification from Claims

To the maximum extent permitted by applicable law, I hereby agree to:

1. waive any and all claims against the manufacturer, distributor, and their respective affiliates, agents, employees, and related parties, including but not limited to claims for personal injury, property damage, or any other harm that may result from my use of the Device; and
2. indemnify, defend, and hold harmless the manufacturer, distributor, and their respective affiliates, agents, employees, and representatives from any and all claims, actions, damages, liabilities, costs, and expenses, including reasonable legal fees, arising from or related to my use of the Device in contravention of the terms of this Policy, or any violation of applicable laws or regulations.

Individuals with pre-existing medical conditions such as hypertension, cardiovascular diseases, or any other condition that may impact blood circulation or breathing are strongly advised to seek medical approval from a qualified healthcare professional before using the wellness breathing device. While the device is designed to potentially increase blood circulation, it is essential to consult with a healthcare professional to ensure its safety and appropriateness for your specific health circumstances. The manufacturer, distributor, and associated parties shall not be held liable for any adverse effects or consequences resulting from the use of the device without appropriate medical approval.
